1. Introduction

1.1 Acceptance of Terms

By accessing, creating an account, or using the cloud storage services provided by North Drive (a product of DigitalCrust), you agree to be bound by this User Agreement ("Agreement"). If you do not agree to these terms, you must not access or use our services.

1.2 Description of Service

North Drive provides cloud storage solutions, including file hosting, synchronization, and sharing capabilities via web, desktop, and mobile applications. The Service is characterized by its focus on sustainability, utilizing restored hardware and green energy, and its unique payment models.

1.3 Changes to Terms

We reserve the right to modify this Agreement at any time. Significant changes will be communicated to you via email or a prominent notice on our platform. Continued use of the Service after such changes constitutes acceptance of the new terms.

2. Definitions & Interpretations

• "DigitalCrust" / "We" / "Us": Refers to the entity operating North Drive, based in Belgium.

  • "User" / "You": Refers to the individual or entity accessing the Service.

  • "Lifetime Plan": A non-recurring payment plan granting access to the Service for the duration of the Product’s Lifespan, as defined in Section 4.1.

  • "Product Lifespan": The operational period during which North Drive continues to offer and support the specific storage plan.

3. Account Registration & Security

3.1 Eligibility & Creation

To use North Drive, you must be at least 13 years old (or the age of digital consent in your jurisdiction). You agree to provide accurate, current, and complete information during the registration process.

3.2 Account Security & 2FA

You are responsible for maintaining the confidentiality of your login credentials. We strongly encourage the use of Two-Factor Authentication (2FA), which we provide to add an extra layer of security. North Drive is not liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Responsibility for Activity

You are fully responsible for all activities that occur under your account. If you suspect unauthorized access, you must notify us immediately.

4. Payment, Subscriptions & "Lifetime" Deals

4.1 "Lifetime" Plan Specifics

By purchasing a "Lifetime" plan (e.g., 1TB or 3TB Lifetime), you acknowledge and agree to the following specific definition of "Lifetime":


  • Definition: "Lifetime" refers to the lifespan of the North Drive product, not the lifespan of the buyer.

  • Duration Goal: Our internal goal is to support this product for a minimum of 15 years.

  • Guarantee: We guarantee the service for as long as North Drive remains operational and independent.

  • Non-Transferable: Lifetime licenses are tied to the original account and are not transferable to other individuals.

4.2 Monthly Subscriptions

If you opt for a monthly subscription plan (where available), your subscription will automatically renew at the end of each billing cycle unless cancelled at least 24 hours prior to the renewal date.

4.3 Refund Policy (7-Day Money-Back Guarantee)

We offer a strict 7-day money-back guarantee on all Lifetime plan purchases. If you are unsatisfied with the Service, you may request a full refund within 7 calendar days of your initial payment. After 7 days, no refunds can be issued for "Lifetime" payments.

5. Data Privacy, Encryption & Sovereignty

5.1 EU Data Protection & GDPR

As a Belgium-based company, we operate in strict accordance with the General Data Protection Regulation (GDPR). You retain full rights to access, rectify, and delete your personal data.

5.2 Encryption

• Standard Encryption: All files are encrypted in transit and at rest.

• User-Managed Encryption: You have the option to encrypt your data using keys known only to you. If you lose these keys, North Drive cannot recover your data, as we have zero knowledge of the content.

5.3 Data Sovereignty

Your data is stored on servers located within the European Union. We ensure maximum protection against external interference and do not comply with foreign data requests unless compelled by a valid EU court order.

5.4 No AI Training Guarantee

We value your intellectual property. North Drive guarantees that your stored files and data are never sold to third parties, nor are they used to train Artificial Intelligence (AI) models.

  1. User Conduct & Acceptable Use Policy

6.1 Prohibited Content

You agree not to store or share content that:


  • Is illegal under Belgian or EU law (e.g., child exploitation material).

  • Infringes on intellectual property rights.

  • Contains malware, viruses, or malicious code.

6.2 Fair Use Policy

While we offer generous storage, the Service is subject to a Fair Use Policy to prevent abuse. This includes limitations on excessive bandwidth usage (e.g., using the account as a Content Delivery Network or "CDN" for high-traffic public websites) that degrades service for other users.

6.3 System Abuse

You must not attempt to probe, scan, or test the vulnerability of our systems, nor breach any security or authentication measures.

7. Content Ownership & Intellectual Property

7.1 Your Ownership

You retain full ownership of all files and data you upload to North Drive. We claim no intellectual property rights over your material.

7.2 Limited License

You grant North Drive a limited, worldwide, royalty-free license solely to host, store, and display your content as directed by you (e.g., to show you a preview of your file) in order to provide the Service.

7.3 DMCA & Takedowns

We respect copyright law. If we receive a valid notification of claimed infringement (DMCA or EU equivalent), we may remove or disable access to the allegedly infringing material and, in repeat cases, terminate the offender's account.

8. Service Availability & Sustainability

8.1 Sustainability & Hardware

You acknowledge that North Drive can utilizes restored and repurposed hardware to minimize e-waste and promote sustainability. We employ rigorous testing and redundancy (RAID) protocols.

8.2 Service Availability

We strive for high uptime, but we do not guarantee that the Service will be uninterrupted or error-free. Downtime for maintenance, updates, or force majeure events is possible.

8.3 End of Life (EOL) Protocol

In the event that the North Drive product is retired (after the target 15-year period or due to unforeseen closure):


  • We will provide a minimum of 6 months' notice.

  • You will be given full access to download and migrate your data during this notice period.

9. Limitation of Liability

9.1 "As Is" Service

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by Belgian law, we disclaim all warranties, express or implied.

9.2 Limitation of Damages

In no event shall DigitalCrust or North Drive be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or loss of data, arising out of your use of the Service. Our total liability shall not exceed the amount you paid to us for the Service.

9.3 Backup Recommendation

While we perform our own backups, you are responsible for maintaining independent copies of your important data. North Drive is not an insurance policy against data loss.

10. Termination

10.1 Termination by User

You may stop using the Service at any time. "Lifetime" payments are non-refundable upon termination after the initial 7-day window.

10.2 Termination by Us

We may suspend or terminate your access immediately if you violate this Agreement (e.g., storing illegal content).

11. Governing Law & Dispute Resolution

11.1 Jurisdiction

This Agreement is governed by the laws of Belgium.

11.2 Dispute Resolution

In the event of a dispute, parties agree to attempt to resolve the matter amicably first. If a resolution cannot be reached, the dispute shall be submitted to the exclusive jurisdiction of the courts located in Flanders, Belgium.
