1. Introduction
1.1 Acceptance of Terms
By accessing, creating an account, or using the cloud storage services provided by North Drive, you agree to be bound by this User Agreement ("Agreement"). If you do not agree to these terms, you must not access or use our services.
1.2 Description of Service
North Drive provides cloud storage solutions, including file hosting, synchronization, and sharing capabilities via web, desktop, and mobile applications. The Service emphasizes sustainability through the use of restored hardware and environmentally conscious infrastructure, alongside alternative pricing models.
1.3 Changes to Terms
We reserve the right to modify this Agreement at any time. Significant changes will be communicated via email or a prominent notice on our platform. Continued use of the Service after such changes constitutes acceptance of the revised terms.
2. Definitions & Interpretations
• "North Drive" / "We" / "Us": Refers to the entity operating North Drive, based in Belgium.
"User" / "You": Refers to the individual or entity accessing the Service.
"Decade Plan/ long-term plan": A long-term storage plan as defined in Section 4.1
"Service": All storage, access, and related features provided by North Drive
3. Account Registration & Security
3.1 Eligibility & Creation
You must be at least 13 years old (or the age of digital consent in your jurisdiction). You agree to provide accurate and complete registration information.
3.2 Account Security & 2FA
You are responsible for safeguarding your credentials. We strongly encourage enabling Two-Factor Authentication (2FA). North Drive is not liable for losses resulting from compromised accounts.
3.3 Responsibility for Activity
You are fully responsible for all activity under your account. You must notify us immediately of any unauthorized access.
4. Payment, Plans & Subscriptions
4.1 Decade Plan Specifics
By purchasing a "Decade" plan, you acknowledge and agree to the following specific definition of "Decade":
• Definition: Provides access to the Service for a target period of up to ten (10) years from activation
• Service Nature: A low-cost, resource-constrained storage offering intended for long-term retention, not high-performance usage
• Performance Limitations: Operates on shared infrastructure; access may be delayed, throttled, or deprioritized
• Modification Rights: North Drive may modify infrastructure, performance, and technical implementation, provided basic storage and retrieval remain functional
• Non-Transferable: Plans are tied to the original account and cannot be transferred
End of Service: Section 8.3 (End of Life Protocol) applies
4.2 Monthly Subscriptions
Monthly plans automatically renew unless canceled at least 24 hours before the renewal date.
5. Data Privacy, Encryption & Sovereignty
5.1 EU Data Protection & GDPR
North Drive operates in compliance with EU GDPR regulations. You retain full rights over your personal data.
5.2 Encryption
• Standard Encryption: All files are encrypted in transit and at rest.
• Optional user-managed encryption is available
• Lost encryption keys cannot be recovered by North Drive
5.3 Data Sovereignty
Data is stored within the European Union and only disclosed under valid EU legal orders.
5.4 No AI Training Guarantee
User data is never sold or used for AI training purposes.
User Conduct & Acceptable Use Policy
6.1 Prohibited Content
You may not store or share content that:
Violates EU or Belgian law
Infringes intellectual property
Contains malware or harmful code
6.2 Fair Use Policy
Our Plans operates under strict shared-resource limits, including:
Bandwidth limitations
• Access rate limits
• Concurrent operation limits
• Priority-based allocation
North Drive may:
• Throttle speeds
• Delay access
• Restrict usage during peak times
• Limit abnormal usage
Prohibited uses include:
• CDN usage
• High-frequency access
• Streaming or real-time distribution
• Performance-critical workloads
Violations may result in restrictions or termination.
6.3 System Abuse
You may not attempt to exploit, benchmark infrastructure or test system vulnerabilities without our permission.
7. Content Ownership & Intellectual Property
7.1 Your Ownership
You retain full ownership of your data.
7.2 Limited License
You grant North Drive a limited license to store and display content solely to provide the Service.
7.3 DMCA & Takedowns
We may remove infringing content and terminate repeat offenders.
8. Service Availability & Sustainability
8.1 Sustainability & Hardware
Infrastructure may include restored hardware with redundancy measures in place.
8.2 Service Availability
The Service is provided on a best-effort, resource-limited basis.
We do not guarantee:
• Minimum speeds
• Immediate access
• Continuous uptime
• High-performance operation
Users accept that:
• Access may be delayed
• Requests may be queued
• Performance may degrade
• Responsiveness may vary
8.3 End of Life (EOL) Protocol
If the Service is discontinued:
We will provide a minimum of 6 months' notice.
You will be given full access to download and migrate your data during this notice period.
8.4 Intended Use
The Decade Plan is designed for:
Long-term storage
Archival use
Backup of non-critical data
Not intended for:
Real-time or business-critical systems
High-performance workloads
Frequent access or hosting
Users are responsible for ensuring suitability.
9. Limitation of Liability
9.1 "As Is" Service
The Service is provided "AS IS", "AS AVAILABLE", and "LIMITED PERFORMANCE".
No guarantees are made regarding:
Performance
Speed
Availability
Access timing
9.2 Limitation of Damages
To the maximum extent permitted by Belgian law, North Drive is not liable for:
Delayed access
Reduced performance
Downtime
Data loss
Indirect or consequential damages
Total liability is limited to the amount paid.
9.3 Backup Recommendation
You must maintain independent backups.
9.4 User Data Responsibility
Users are solely responsible for their data.
We do not guarantee:
Durability
Redundancy
Recovery
The Service must not be used as the sole storage for critical data.
10. Termination
10.1 Termination by User
You may stop using the Service at any time.
10.2 Termination by Us
We may issue a warning, suspend, or terminate your access immediately if you violate this Agreement, including by storing or sharing illegal content.
10.3 Refund Policy
• Refunds available within 30 days
After 30 days, payments are non-refundable unless required by law
Users acknowledge reduced guarantees due to pricing
11. Governing Law & Dispute Resolution
11.1 Jurisdiction
This Agreement is governed by the laws of Belgium.
11.2 Dispute Resolution
Disputes shall first be attempted amicably, then resolved in the courts of Flanders, Belgium.
